The Law (Constitutional) to free exercise of propaganda.

The Constitutional Right to free exercise of propaganda finds its foundation in the right to information, which is backed in art.5º of the 1988 Constitution, in some of its clauses.
The right to information is characterized as diffuse law, or of enjoyment by holders and numerous undetermined, namely, the entire social body. Listed among the fundamental rights, the right to information has her first appointment in section XIV of the article above, and reinforced by items XXXIII and XXXIV, and by the Article 220 of the same law.
There are still forecasting the Right to Information in the American Convention on Human Rights, in Article 13, which Brazil is a signatory, having ratified the treaty in 1992.
Despite all these forecasts expressed in our legal system, which is noticed is that press freedom is exercised so exacerbated disrespecting the right information to the citizens, who arrives distorted and it faking reality, since the means of mass communication, in our times, play a key role in redesigning the socio-political-economic world. The dissemination of information denotes, for Western society, progress in personal and collective freedoms, and also the negotiation and exchange of global flows in space. Civil liberties guaranteed by the Constitution, are not synonymous. The right to share opinions and scatter information ensures the functioning of a democratic system, have the right to truthful information to the premise meets the requirement of knowledge, essential for man to perform a citizen in a complex society and transformed by technological advances scientific.
The exercise of citizenship should not be viewed apart from the social and political context - as it is closely linked to it. The people depend on information to act on their social environment. These findings emphasize the dependence of the lower classes, TV and radio, serving as a source of entertainment and knowledge, being used as a benchmark for their basic needs for knowledge and interaction, such classes are based on your configuration of reasoning, deliberation, it self knowledge and social practices in the data they receive for these vehicles. Still, young people, because they lack a well-formed identity, also tend to be influenced by what guarantees them more self-assertion. In a country with semi-direct democracy (as the people participate directly in some situations such as referendums and plebiscites), such as Brazil, is concerned the dominance of television as a potential risk to the ability of choice and options for citizenship. Due to the relevance of information to the full enjoyment of social and individual rights and the welfare of a fraternal society (preamble of the Constitution of 1988), can also support the right to be informed on several fundamental principles of constitutional. Indeed, without the receipt of pluralist information, the citizen will not exercise their citizenship with dignity and sovereignty of the people will, inevitably, emptied.
